Research on the Redemption of Right System in the Law of Social Assistance

Abstract

|
In the area of social assistance, redemption of rights is important to secure people’s right to live. The right to receive substantial government subsidy for living expenses comes from human right of the people supported by Constitution. The right to receive public assistance is the individual public right that is based on individual circumstance and need. With these characteristic, the right to receive substantial government subsidy for living expenses is too dependent on the discretionary legislation. Both to control the discretionary legislation and to guarantee the right of beneficiaries, we need concrete system about the redemption of rights. With this perspective, as it is found that the current system of redemption of rights have several problems, in order to reforming these factors, I present a few alternative suggestions. First, we need a specialized organization which has responsible for the redemption of right. Second, we have to enlarge the condition of redemption of the right so that we are able to prohibit the administrative omission and to protect our right of beneficiaries. Third, it is so essential to have dual system for redemption of right. And the last, we have to make partial amendment to the public assistance laws: period for redemption of rights, a starting point for reckoning. It can help people to exercise their redemption of rights fully.
